Invoice and Service Agreement

Payment:
50% Non-Refundable deposit is required to hold the date, invoice will be sent separately.
Remainder due at time of service, except checks must be paid in full.

Cancellation Fee:
If the event is cancelled within 24 hours of start-time, payment is due in full. Prior to that, there will be a cancellation fee of 50% for each date postponed or cancelled (paid via non-refundable booking fee). Client agrees to pay full amount even if client actually uses artist(s) for less time than booked.

Pace of Work:
Artists usually paint at the rate of approximately 10 - 25 children per hour, depending on the request. This is considered “fast” or “quick.” For our quick designs especially, the number of children that we can get through depends a great deal on how quickly the children can decide on what they want and how still they are able to sit when being painted. If you need to get through a large number of children in a small amount of time, we often recommend that you have an adult or teenager be in charge of line management. If you have booked 1 hour of face painting, and you end up with more than the children discussed at your party, or children are coming back for seconds and thirds, expect that your artist will discuss the option of booking extra time with you.

Overtime:
Any time beyond the time agreed will cost $1 per minute per artist, but only if they have availability.

Setup and Arrival:
We will set-up once at no charge. Any additional set-up, moving locations, etc, must be compensated.  Typically we arrive 15-30 minutes early, so we will need access to the event site at that time.

Modifications:
If you need to change the date, time, or number of staff you require before your event, you must sign the new agreement, and submit down payment to cover changes.

Returned Checks: There will be a $50 fee for returned checks, plus the amount of the check.

Shelter, Water Activities, Sporting Events:
Artists can work outdoors under proper weather conditions, but a suitable shelter (i.e., tent, canopy, umbrella) is required. Artists do not work in direct sun, or in rain, etc, since this affects the supplies. There is a charge for the artist to bring a canopy (5’x5’ or 10’x10’). If you are planning water activities, such as squirt guns, water shooters, dunk tank, or water balloons; or sports, such as basketball, soccer, baseball, or football, you must arrange for your artist to paint in an area that is safely removed from these activities. Also, face or body paint and henna is not waterproof and may come off during water activities.  Please make sure to request alcohol based paints for water related activities.

Parking:
Parking must be provided for the artist near the event location, so that equipment may be unloaded. If arrangements cannot be made for parking close to the location, then the client agrees to provide staff to unload equipment and deliver to the painting location. The client will reimburse the artist for any parking fees.

Liability Statement:
Client agrees that Memphis Face Painting, LLC, and the artist(s), are not liable for reactions to materials used in painting, such as paint/ink/adhesive/glitter/henna. Henna contains only natural ingredients, red henna (Lawsonia inermis), lemon juice, sucrose, and essential oils of Cajeput, Eucalyptis, and/or Lavender. Does not contain chemical dyes, PPD, preservatives or nut derivatives.

Your guests should avoid henna if they have G6PD deficiency or have been advised to avoid Fava beans, are extremely anemic, or have citrus allergies. Consult a physician if you have any concerns or are pregnant and would like to use henna. It is the client’s responsibility to notify the artist if they or their child has sensitive skin. For safety reasons, artists will not work on children under two years old for face paint and under 6 for henna. For sanitary reasons, artist will not work on anyone who is or appears to be sick or be suffering from cold sores, conjunctivitis, any infections or skin conditions, eczema, or open wounds. Client agrees that Memphis Face Painting, LLC, and artist(s), are not responsible for damage to clothing, property, or persons.

Face Painter Responsibility:
The artist will clean the workstation, you provided, back to the original manner you provided it. The artist will adhere to industry health and safety practices, including using make up, brush, and sponge sanitizers to minimize cross contamination. Brushes will be washed and water will be changed frequently during the event. All equipment is washed thoroughly after an event. Only FDA compliant and cosmetic grade products will be used. Artist(s) will not supervise children. Their behavior and safety are the parent’s responsibility. Artist cannot see other children while he/she is painting.

Promotional Material:
Artist reserves the right to display and distribute promotional material during the event. Artist may bring products to sell at the event. If photos are taken by the artist, they will be obtained with expressed permission from participants and will be used solely for the purpose of promoting the business. The artist will not link identities to any of the photos used or given to third parties. Social media – expressed permission will be sought by the artist for uploading photos to social media. Once uploaded the photo will be subject to site policies, and the artist no longer holds responsibility.
